EMPLOYMENT LITIGATION
Our employment litigation practice encompasses litigation in federal and state courts, as well as before administrative agencies such as the EEOC, the New York State Division of Human Rights, the New York City Commission on Human Rights, the Connecticut Commission on Human Rights and Opportunities, the Massachusetts Commission Against Discrimination, the New Jersey Division on Civil Rights, and the Pennsylvania Human Relations Commission.
We have defended discrimination claims brought under Title VII, Section 1981, the Americans with Disabilities Act, the Age Discrimination in Employment Act, the Equal Pay Act, the Pregnancy Discrimination Act, the Family and Medical Leave Act, the New York Human Rights Law, and the New York City Administrative Code. We have also litigated employment-related tort and contract claims, including allegations of breach of employment contract, breach of the covenant of good faith and fair dealing, fraud, defamation, negligent and intentional infliction of emotional distress, tortious interference with contract, and interference with prospective economic advantage.
Our employment litigation experience includes successfully defending employment discrimination and other claims at every procedural juncture: that is, we have been able to obtain “no probable cause” dismissals in the overwhelming majority of discrimination cases filed against our clients before administrative agencies; we have repeatedly succeeded in having discrimination and other employment-related complaints dismissed from federal and state courts on motions for summary judgment; we have achieved jury verdicts in our clients’ favor; and we have succeeded in having Courts of Appeal affirm the victories that we have achieved at the trial court level.
Recent notable employment litigation achievements include:
- A jury verdict in defendant’s favor in a race and religious discrimination/retaliation case filed in the District of Connecticut
- A jury verdict in defendant’s favor in a sexual harassment and retaliation case filed in the Southern District of New York
- A jury verdict in defendant’s favor in a race, national origin, and sex discrimination case filed in the Southern District of New York
- A Second Circuit decision affirming a grant of summary judgment in a sexual harassment, sex discrimination, and Equal Pay Act case
- A Second Circuit decision in client’s favor in an ERISA and breach of contract case
